These Terms of Service (“Terms”) govern your use of this website and your purchases from Haiti Legacy Collection (“Haiti Legacy,” “we,” “us,” or “our”). By using the site or placing an order, you agree to these Terms. If you do not agree, please do not use the site.

1. About us

Haiti Legacy Collection is a subsidiary of Virgile Consulting, LLC, a limited liability company based in the State of Utah, United States. References to “we” and “us” include Virgile Consulting, LLC and Haiti Legacy Collection.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. If you are younger, a parent or guardian must place the order for you.

3. Using the site

You agree to use the site only for lawful purposes and in line with these Terms. You must not interfere with the site’s operation or security, try to access accounts or data that are not yours, scrape the site at a rate that harms it, or use the site to send spam or malicious code.

4. Products, pricing, and availability

Prices are shown in U.S. dollars unless stated otherwise. Colors on your screen may differ slightly from the product. We try to keep descriptions, prices, and stock information accurate, but errors can happen. We may correct an error, cancel an order affected by an error, or limit quantities. If we cancel an order after you have paid, we will refund you in full.

5. Orders and payment

Your order is an offer to buy. We accept it when we send a shipping confirmation. We may decline or cancel any order, including for suspected fraud. Payment is processed by third-party payment providers, and you agree to provide accurate payment and contact details. Applicable sales tax is added at checkout where required.

6. Shipping and delivery

We ship worldwide. Delivery dates are estimates, not guarantees. Risk of loss passes to you when the carrier delivers the package. For international orders, you are responsible for customs duties, import taxes, and fees charged by your country.

7. Returns and refunds

If you are not happy with an item, contact us within 30 days of delivery to ask for a return. Items must be unused and in their original condition and packaging. Personalized items (for example, jerseys with a name or number) and items marked final sale cannot be returned unless they arrive damaged or defective. If an item arrives damaged, defective, or incorrect, contact us and we will replace it or refund you. Approved refunds are issued to the original payment method. Return shipping costs are the customer’s responsibility unless the return is due to our error.

8. Personalized products

When you add a name or number to a product, please check spelling and spacing before you order. We produce personalized items exactly as you enter them. We may refuse to print text that is unlawful, hateful, infringing, or otherwise inappropriate.

9. Books and digital content

Books and other content we sell are protected by copyright. Your purchase gives you a personal, non-transferable right to read and use your copy. It does not give you the right to copy, distribute, or resell the content.

10. Community content and uploads

If we let you submit stories, photos, videos, music, reviews, or other content (“Your Content”), you confirm that you own it or have permission to share it and that it does not infringe anyone’s rights or break the law. You keep ownership of Your Content. You give us a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute Your Content on our website, apps, and social channels in connection with Haiti Legacy Collection. We may review, decline, or remove content at our discretion, including content that is hateful, harassing, sexually explicit, or infringing.

11. Intellectual property

The site and everything on it, including the Haiti Legacy Collection name, logos, emblem designs, jersey and apparel artwork, photographs, text, and book content, belong to us or our licensors and are protected by intellectual property laws. You may view the site and use our products for personal, non-commercial purposes. You may not copy, reproduce, modify, or sell our designs or content without our written permission. Other names, logos, and trademarks that appear on the site belong to their respective owners and do not imply any endorsement.

12. Giving back

We state that a portion of purchases supports education and youth programs in Haiti. The programs, partners, and amounts may change over time. Your purchase is a purchase of goods, not a charitable donation, and it is not tax-deductible.

13. Third-party links and services

The site may link to third-party websites and use third-party services, such as payment providers and shipping carriers. We are not responsible for their content, policies, or practices.

14. Disclaimers

The site and our content are provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the site will be uninterrupted or error-free. Some places do not allow certain disclaimers, so some of these may not apply to you.

15. Limitation of liability

To the fullest extent allowed by law, Virgile Consulting, LLC, Haiti Legacy Collection, and their owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of your use of the site or products. Our total liability for any claim relating to the site or a purchase will not exceed the amount you paid for the product that gave rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.

16. Indemnification

You agree to defend and hold harmless Virgile Consulting, LLC, Haiti Legacy Collection, and their owners, officers, employees, and agents from claims, losses, and expenses, including reasonable attorneys’ fees, arising from Your Content, your misuse of the site, or your breach of these Terms.

17. Governing law and disputes

These Terms are governed by the laws of the State of Utah, United States, without regard to its conflict-of-law rules. Before filing a claim, you agree to contact us and try to resolve the dispute informally for at least 30 days. If we cannot resolve it, any dispute will be brought exclusively in the state or federal courts located in Utah, and you and we consent to those courts’ jurisdiction. If you are a consumer, this section does not take away any mandatory consumer protections that apply to you where you live.

18. Changes and termination

We may update these Terms from time to time by posting the new version on this page with a new “Last updated” date. Your continued use of the site after that date means you accept the changes. We may suspend or end your access to the site at any time if you breach these Terms.

19. General

If any part of these Terms is found unenforceable, the rest stays in effect. If we do not enforce a provision, that is not a waiver. These Terms, together with our Privacy Policy, are the entire agreement between you and us about the site.
